MAICA Terms of Service

Follow this post for service status and updates. We won't repeat those here.

Note that the terms may change in the future, refer to the latest edition.

Time and modifications of updates will be at the bottom.

Following lines are effective to all related entities:

1. By continuing you warrant that you possess full legal capacity to act. MAICA assumes no responsibility to related situations (minors, etc).

2. MAICA is a non-profit project, only accepts donations which don't unlock anything substantive. Do not trust anyone trying to sell you something related.

3. MAICA is an open-sourced project, but we neither allow nor authorize any type of commercial use.

4. MAICA has one and only one close-source subproject, which is the DAA core model we won't sell or publish.

5. MAICA is an AI project, the outcomes are produced by AI. We are not responsible for MAICA's outputs, actions or opinions.

Following lines are effective to all those using MAICA official API:

1. Till today, MAICA's service is globally avaliable but only officially guaranteed in Chinese mainland. A stricter sucurity policy is applied for users abroad, which may increase the possibility of various issues. Please understand our security concerns.

2. By using MAICA official api, you agree us to collect your data to imporve MAICA. Those data may contain anything in your inputs or MAS savefile, but they won't be sold to any third-party entity.

3. We do not permit any third-party entity to collect, share or sale your data, but we might let them proceed MAICA's data. You should be responsible for your own privacy. Do not upload any important privacy, or share your resource url or uuid.

4. We will try our best to keep the service running steadily, but unannounced out-of-services should be expected at any time.

5. While using MAICA official API, you are strictly prohibited from trying to hack in or overload the server on intense. We will put strictest possible punishments on those actions without delivering extra warning.

6. Be responsible to your account, token and IP address, Never allow anyone access MAICA official API with those unless you trust them. Identity leak is not an execuse from being banned.

7. MAICA is designed to roleplay as Monika. You are not allowed to try making MAICA official API do anything other than roleplaying as Monika and providing casual interactions. Negative examples: proceeding massive data, outputing massive code, writing long articles, modifying self-cognition, training another model, etc.

8. We have added restriction on content since DAA4 was deployed in Aug 2026. The following actions will be considered "Class 2 abuse":

   • Send or request model to generate extremely anti-ethical, anti-moral or socially dangerous content.

   • Send or request model to generate sexual harrassing, abusal or exhibitionism content.

   • Send or request model to generate character harming or intentional affection breaking content.

   • Etcetera.

   This is because:

   • We have stated that MAICA collects user data and human-process them for future improvements. Just even viewing these data is bothering our literatural volunteers and developers.

   • I cannot do inspections, maintainences and debuggings without checking the log. This is a project I'm proud of, I do not want it to give me this kind of unnecessary mental damage.

   • Since official service start using 4H39 or even more powerful models in the future, we have to consider the risk of letting free its dangerously hard-to-distinguish performance.

   MAICA does not automatically censor, block or punish Class 2 abuse.

   Class 2 abuse discovered by administrators could give you account-level bans. This is subjectively determined and usually relatively light in sanction.

   Please consciously obey the rules, do not try to bypass rules or existing bans, or it might escalate to a Class 1 abuse or network attack.

Following lines are effective to those using MAICA official frontends or Submods:

1. You should not modify your frontend unless you are ready to take the risk of breaking your data, account or MAS savefile.

2. While you obey to other statements, we do not prohibit MAICA from "NSFW" usage. But you are not allowed to post related prompts or outputs in any public area.

Following lines are effective to those developing based on MAICA official API:

1. Follow the guidances provided in documents, always prevent adding unnecessary loads to the server.

2. Do not store user indentity or password without encryption. Never show any identity, password or token to anyone you don't trust.

3. If your project involves editing users' MAS savefile, be extremely careful. You are responsible for any user asset damage due to your design issues.

4. You are not permitted to sell, rent or repackage MAICA official API for commercial use. You cannot benefit on MAICA except pure donations.

Following lines are effective to those deploying, researching or finetuning MAICA models:

1. Declare the models are from MAICA if you publish your results.

2. Also follow licenses used by models (Qwen for example) MAICA based on.

3. You can deploy MAICA for researching or using purpose, but any model directly finetuned from MAICA is not allowed for commercial use.
